On the scope of application of the conflict rules derived from Article 12 paragraph 1 and Article 13 paragraph 1 of Regulation No. 883/2004 – some comments in the context of the judgment of the Supreme Court of 24th March 2026, II USKP 359

The subject of this study is the issue of delimiting the scope of application of the conflict rules derived from Article 12(1) and Article 13(1) of Regulation No. 883/2004, arose against the background of the factual circumstances of the Supreme Court judgment of 24th March 2026, II USKP 359/26. By providing a linguistic interpretation of the indicated provisions and taking into account the different objectives of the conflict rules derived therefrom, the author contrasts posting as a unilateral act of the employer, being an expression of his management powers, and the ‘normal pursuit of work in two or more Member States’ (simultaneously or alternately), resulting from the provisions of the employment contract(s) specifying the place(s) of work in two (or more) Member States. The article critically discusses the criterion of ‘duration of activity’ (Article 14(7) of Regulation No. 987/2009), emphasizing the importance of the criterion of foreseeability (Article 14(10) of Regulation No. 987/2009).

Keywords: coordination of social security in the EU; posting of workers; normal work in two (or more) Member States; establishing of the applicable legislation; free movement of workers; free movement of services
