Europejskie prawo kosmiczne – nowe prawo dla nowej branży?

Sektor kosmiczny ewoluował od naukowej ciekawostki do istotnego składnika nowoczesnych gospodarek i codziennego życia, wpływając zarówno na ugruntowane potęgi kosmiczne, jak i wschodzących liderów. Technologie satelitarne, kluczowe dla komunikacji, obserwacji i nawigacji, ułatwiają globalną łączność i zarządzanie ryzykiem katastrof, podkreślając ich znaczący potencjał gospodarczy i obronny. Rosnąca złożoność działalności kosmicznej, w tym turystyki kosmicznej i wydobycia zasobów, podkreśla potrzebę adaptacyjnych ram prawnych w celu zapewnienia zrównoważonego rozwoju i bezpieczeństwa. Tradycyjne prawo kosmiczne musi ewoluować, aby sprostać nowym wyzwaniom, takim jak śmieci kosmiczne i zagrożenia cybernetyczne. Niedawne dyskusje wokół inicjatywy Unii Europejskiej mającej na celu ustanowienie europejskiego prawa kosmicznego odzwierciedlają pilną potrzebę stworzenia spójnych przepisów, odzwierciedlających potrzeby europejskiej konkurencyjności i bezpieczeństwa oraz zrównoważonej eksploracji kosmosu. Celem badawczym artykułu jest analiza powodów przemawiających za i przeciw europejskiemu prawu kosmicznemu, a także potencjalnych metod jego przyjęcia. W tym celu zostanie przedstawione status quo prawa kosmicznego na poziomie globalnym, regionalnym oraz krajowym. Następnie zostaną poddane analizie powody podjęcia inicjatywy ustawodawczej przez UE, jej aspekty merytoryczne i proceduralne.
