Mgr Katarzyna Kamińska, she completed MA studies in Law at the Faculty of Law and Administration of the University of Warsaw and BA studies in Management and complementary master's studies in Finance, Accounting and Insurance at the Faculty of Management at the University of Warsaw. She is a graduate of the doctoral studies at the Faculty of Law and Administration of the University of Warsaw. She is preparing a PhD dissertation in the field of social security under the supervision of prof. dr hab. Inetta Jędrasik-Jankowska from the Department of Insurance Law. In the public debate, the additional annual pecuniary benefit for pensioners operates under the term "thirteenth pension". The purpose of the article is to assess the legal nature of this benefit and to answer the question whether it constitutes the implementation of the constitutional right to social security expressed in Article 67 of the Constitution. For this purpose, the

author discusses the provisions of the Act of 9 January 2020 on additional annual pecuniary benefit for pensioners, assessing them through the characteristic features of traditional methods implementing the idea of social security. The analysis leads to the conclusion that the additional annual pecuniary benefit is an instrument of social security, to some extent falling within the scope regulated in Article 67 of the Constitution.
